Your Child’s Right to Education

At Oceanside Unified School District, our top priority is the safety and well-being of our students and families. We are committed to providing a welcoming and supportive environment for all, regardless of immigration status. We encourage families to review our immigration policy, which outlines protections for students and ensures that all children have access to a quality education without fear or discrimination. Our schools remain safe spaces where every student is valued and supported.

We want families to know that every child in the Oceanside Unified School District (OUSD) has the right to attend school, regardless of their immigration status, as protected by federal law, state law, and local school board policy.

OUSD does not request or record information about a student’s immigration status. Federal and state laws protect student information from disclosure to others, including Immigration and Customs Enforcement (ICE). OUSD does not permit non-students, including ICE agents, to access OUSD facilities unless they present a warrant signed by a federal judge. School administrators will not disclose confidential student information without first consulting legal counsel to ensure the request is properly subject to a federal judge’s warrant.

Federal Law

All children in the United States have the right to a free public education, regardless of their immigration status.

  • In 1982, the Supreme Court ruled in Plyler v. Doe that states cannot deny students a free public education based on their immigration status. 

State Law

California Education Code section 234.7 prohibits school officials from collecting information about a student's immigration or citizenship status. This includes information about the student's family members.
